Stare decisis

Stare decisis es una locución latina, que se traduce interpretativamente como "mantenerse con las cosas decididas", utilizada en derecho para referirse a la doctrina según la cual las sentencias dictadas por un tribunal crean precedente judicial y vinculan como jurisprudencia a aquellas que, sobre el mismo objeto, se dicten en el futuro.

Esta locución más breve proviene de resumir una más extensa que dice: Stare decisis et non quieta movere.

Esta doctrina es propia del derecho anglosajón, y no tiene tanta fuerza en sistemas de derecho continental, en donde la jurisprudencia tiene una obligatoriedad mucho más reducida y la capacidad del juez de interpretar la ley según su criterio es mucho más amplia.

La mayoría de los sistemas, sin embargo, reconocen que la jurisprudencia reiterada debe de alguna forma vincular a los jueces pues, si bien son independientes, es necesario evitar que sus sentencias sean totalmente imprevisibles, o que dicten sentencias contradictorias, o de forma caótica.
